DMCA Copyright Policy

Chatalystar (operated by Chatalystar Corporation) is an online service provider that hosts content uploaded by independent creators and other users. We respond to clear, complete notices of alleged copyright infringement that comply with the DMCA and we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.

If you believe in good faith that material accessible on Chatalystar infringes your copyright, you may send a written notice to our DMCA Designated Agent. To be effective under 17 U.S.C. § 512(c)(3), your notice must include substantially the following:

• A physical or electronic signature of the copyright owner, or a person authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed;
• Identification of the copyrighted work claimed to have been infringed (or, if multiple works at a single online site are covered by a single notice, a representative list of such works);
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit us to locate the material (URLs are strongly preferred);
• Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address;
• A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If your content has been removed or disabled in response to a DMCA takedown notice and you believe in good faith that the removal was the result of mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g). Your counter-notice must include substantially the following:

• Your physical or electronic signature;
• Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
• A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Chatalystar may be found, and that you will accept service of process from the person who provided the original notification or an agent of such person.

On receipt of a valid counter-notice, we will promptly forward a copy to the party who submitted the original takedown notice and inform them that we may replace the removed material or cease disabling access to it in 10 to 14 business days unless we first receive notice that an action has been filed seeking a court order to restrain the user from infringing activity relating to the material.

Consistent with 17 U.S.C. § 512(i), Chatalystar maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We may also terminate accounts at any time, with or without notice, where we receive credible evidence of egregious or repeated infringement.

Chatalystar's DMCA Designated Agent is registered with the U.S. Copyright Office under registration number DMCA-1071660.
