Record-keeping compliance for visual depictions of actual sexually explicit conduct published, hosted, or distributed via Chatalystar (operated by Chatalystar Corporation, a Canadian corporation).
All visual depictions of actual sexually explicit conduct made available through the Chatalystar website, mobile applications, and related services (collectively, the "Service") are managed in accordance with 18 U.S.C. § 2257 and 28 C.F.R. Part 75 to the extent those provisions apply, and with applicable Canadian privacy and content laws including the Personal Information Protection and Electronic Documents Act (PIPEDA).
Chatalystar Corporation does not itself produce visual depictions of sexually explicit conduct within the meaning of 18 U.S.C. § 2257. The platform provides hosting, distribution, and payment infrastructure to independent verified adult creators ("Muses"), each of whom is solely responsible for the production of their own content and for any primary record-keeping obligations attaching to that production under 18 U.S.C. § 2257 and § 2257A.
With respect to content produced by independent creators and uploaded to the Service, Chatalystar Corporation acts solely as an online service provider that transmits, stores, retrieves, hosts, formats, or translates communications and content provided by or at the direction of third parties. Chatalystar Corporation relies on the safe harbor provided in 18 U.S.C. § 2257(h)(2)(B)(v) for such third-party content and does not exercise editorial or production control over the underlying visual depictions.
Each verified creator agrees, as a condition of using the Service, to:
All creators on Chatalystar must complete third-party identity and age verification through Veriff, an independent identity-verification provider, prior to uploading any content. Verification confirms that each creator is at least 21 years of age (Chatalystar's platform-wide creator minimum, which exceeds the 18-year federal floor under 18 U.S.C. § 2257) and matches a government-issued identity document.
Access to sexually explicit content on the Service is gated behind third-party identity and age verification (via Veriff) for viewers as well as creators. No user may view such content without first completing this verification, and the Service blocks access to the underlying media until verification is successfully recorded against the viewer's account. Verification records are retained in accordance with our Privacy Policy and PIPEDA.
For content uploaded to the Service, Chatalystar Corporation maintains, with respect to each verified creator and to the extent reasonably available:
These records are retained for the period required by applicable law and are available for inspection by an authorized officer or representative of the U.S. Attorney General as required by 28 C.F.R. § 75.5, in accordance with the procedures and limitations of that section and consistent with applicable Canadian law.
